EN3 Sunprotection Inc. is pleased to announce that a commercial arbitration tribunal has issued a final award fully dismissing all intellectual property claims brought against it by Altex Décoration Ltée (7912854 Canada Inc.) (“Altex”).
Altex had alleged that EN3 Sunprotection Inc., Sunprotection Group Inc., Enrico Nardone, and Stefano Nardone breached purported exclusivity rights, misappropriated trade secrets, infringed trademarks, and competed unfairly. Altex first brought these claims before the Federal Court of Canada, the Ontario Superior Court and the Quebec Superior Court, before all disputes were consolidated in a single arbitration.
The arbitration dismissed all of these claims in full. The arbitrator went on to rule as follows:
Declare that, beginning with the departure of Enrico and Stefano Nardone from Altex in July 2015 inclusive and at all times pertinent thereafter, Defendants Stefano Nardone, Enrico Nardone and EN3 Sunprotection Inc. and Sunprotection Group Inc.:
• did not compete unfairly with Altex while selling shades on Altex’s territory; and
• did not commit acts of passing off in regard to Altex’s trademarks, Altex’s shade specifications, and EN3’s shades.
The arbitrator even ordered Altex to pay to EN3 Sunprotection Inc. the costs of the arbitration as compensation.
This award conclusively confirms EN3 Sunprotection’s longstanding position that its business activities have been conducted lawfully, independently, and in full compliance with applicable legal and commercial standards.
This award further reinforces that Sunprotection Group Inc. and EN3 Sunprotection Inc. are two distinct companies with different aims and established reputations.
